Ce lundi 16 septembre, Fatou Bensouda, la Procureure de la Cour pénale internationale (CPI) a fait appel de la relaxe de Laurent Gbagbo et Charles Blé Goudé. Une nouvelle procédure est désormais engagée à l’issue de laquelle la Chambre d’appel de la CPI délibèrera sur le sort de l’ex président ivoirien et de son protégé.
Fatou Bensouda en décidant ce lundi de faire appel de l’acquittement de Laurent Gbagbo et Charles Blé Goudé a surtout renvoyé hypothéqué les chances de l’ancien président ivoirien d’être présent dans son pays pour les élections présidentielles de 2020, comme le souhaitaient ses partisans. En effet, jusqu’à ce que la nouvelle procédure qui vient de s’ouvrir n’aboutisse, l’ex homme fort d’Abidjan et l’ancien chef des Jeunes Patriotes de Côte d’Ivoire, n’ont pas le droit de quitter leurs lieux de résidence actuels et encore moins de retourner en Côte d’Ivoire.
Pour justifier sa décision, la Procureure de la CPI a indiqué que les luges qui ont prononcé la relaxe des deux acteurs politiques ivoiriens en janvier dernier, ont commis un certain nombre d’erreurs de droit. « L’appel démontrera que la chambre de première instance a commis des erreurs de droit et de procédure qui ont abouti à l’acquittement de Laurent Gbagbo et de Charles Blé Goudé pour tous les chefs d’accusation », lit-on dans un communiqué le bureau de la procureure. C’est parti pour 30 jours, pendant lesquels, l’accusation pourra produire un mémoire dans lequel il fournira tous les détails des éléments motivant sa demande d’appel. Les Conseils de Laurent Gbagbo et Charles Blé Goudé auront à leur tour 30 jours, pour à leur tour préparer leur défense. La Chambre d’appel de la CPI devra ensuite se prononcer sur la conformité de la décision prononcée en première instance et décidé de la réouverture du Procès ou tout simplement débouté, le Bureau de la Procureure.
