Le Directeur de cabinet du ministre des Transports, M. Diallo Amadou Issifi a présidé le 27 Juillet, à Niamey, une conférence de presse relativement à l’institution du nouveau permis de conduire biométrique. « Notre démarche consiste à dissiper les zones d’ombre, à mettre fin aux agissements parfois infondés, à expliquer la procédure de la passation de la convention et les enjeux de cet important projet aux usagers », a dit Diallo Amadou Issifi lors de cette conférence de presse. Il était appuyé dans cet exercice par le Directeur des Marchés Publics et des Délégations de Service Public, du Directeur de la Circulation et de la Sécurité Routière, du Directeur de la Législation ainsi que du Sécrétaire Général dudit ministère qui ont apporté des éclaircissement sur le processus qui a abouti à la signature de la convention de cession portant réalisation d’un permis de conduire biométrique et des Titres de Transports sécurisés avec la Société Haroun Printing en «BOT : Built-Operate-Transfert» qui n’est qu’une concession de service public.
Dans son mot introductif, le Directeur de cabinet du ministre des Transports, M. Diallo Amadou Issifi a rappelé que la diffusion du communiqué du ministère des transports en date du 19/7/2019 informant les usagers du démarrage des activités de traitements et d’édition du permis de conduire biométrique a suscité toutes sortes de spéculations et de critiques au sein de l’opinion nationale notamment à travers les réseaux sociaux, qualifiant ces spéculations et critiques ‘’d’infondés’’. Selon lui, les objectifs poursuivis à travers cette convention «c’est de moderniser le permis de conduire en remplaçant le permis en carton par celui en PVC (Polyvinyle Chloride ) sous forme de carte de crédit pour être au diapason de la nouvelle technologie dans le domaine, de sécuriser les titres de Transports, d’acquérir une base de données fiables avec l’usage de la biométrie, de sécuriser les données avec les méthodes les plus modernes, de conférer au permis de conduire nigérien un caractère infalsifiable avec les éléments de sécurité qu’il comporte, de répondre à l’exigence de la loi N°2014-62 du 5 novembre 2014 qui institue un fichier administratif concernant le permis de conduire appelé ‘’Fichier National du Permis de Conduire’’, de mettre en œuvre le décret 2017-518/PRN/MT du 16 Juin 2017 portant modalités d’application de la loi précitée qui institue de nouvelles catégories de permis de conduire au Niger, de résoudre le problème récurrent de rupture d’imprimés de permis de conduire et d’améliorer et sécuriser les recettes de l’Etat au titre des redevances perçues pour la délivrance de permis et des titres de transports ».
Selon le Directeur de cabinet du ministre des Transports, le Projet de réalisation du système de permis de conduire biométrique est un vieux projet qui date de 2015. « En Janvier 2015, déjà, le Ministère des Transports a tenté de réaliser ce projet en publiant un avis à manifestation d’intérêt dans le « Sahel » du 6 Janvier 2015. Malheureusement cette tentative n’a pas abouti », a-t-il ajouté. Aujourd’hui, « compte tenu du développement important que connaissent les infrastructures de transports et le nombre croissant de demandeurs de permis de conduire, la rupture quasi permanente des imprimés et surtout la réforme du code de route qui a introduit de nouvelles catégories de permis qui ne peuvent pas figurer sur le permis en format papier ; la nécessité de poursuivre le processus de modernisation du permis de conduire s’est imposée à nous », a-t-il expliqué.
De son côté, le directeur des Marchés Publics et des Délégations de Service Public, M. Ibrahim Hamani a beaucoup insisté sur la transparence qui a prévalu tout au long du processus de passation de marché qui « s’est déroulé dans les règles de l’art ». Il a rappelé que le 8 août 2018, le Ministère des Transports a publié, l’avis à manifestation d’intérêt, au nom du principe de transparence de code de passation de marché. « Lorsqu’il y a contrat de délégation de service il y a nécessairement mise en concurrence et la mise en concurrence est toujours précédée de pré qualification ; donc il y a la publication de cet avis au moment de la première phase en vue de présélectionner une liste restreinte des candidats qui auront à produire des offres techniques » a-t-il expliqué. M. Ibrahim Hamani a dit qu’après cette publication, le Ministère des Transports a pris un arrêté en vue de créer une commission en charge d’analyser et de dépouiller les offres des différents soumissionnaires.
Cette commission est composée d’un représentant du Secrétariat Général du Ministère des Transports (président de la commission), un représentant de la direction des Marchés Publics, un représentant du Ministère des Finances, celui de la Chambre de Commerce et un huissier de justice qui après son travail a produit un PV. Il a ajouté qu’il ya eu une autre commission composée des experts pour analyser les avis à manifestation d’intérêt des différents candidats. Cela a permis de réceptionner six offres émanant des candidats qui ont été retenus dont Haroun Printing, une société de droit libanais au moment de la première phase ou phase de pré qualification. « A la phase restreinte, c’est-à-dire après analyse des experts, parmi les six, trois ont été retenus dont Haroun Printing » a-t-il noté. Après le contrôle a priori et l’avis favorable du contrôleur financier, l’on est passé à la deuxième phase. Le Ministère des Transports a envoyé des lettres aux soumissionnaires présélectionnés afin qu’ils préparent leurs offres techniques et financières et les déposer à la date prévue. « C’est dans cette démarche que le processus a continué jusqu’à la phase de la signature et d’approbation du marché. En résumé toute la réglementation en termes de passation de marché a été respectée de bout en bout », a-t-il assuré.
Pour sa part, le directeur de la
Circulation et de la Sécurité Routière, M. Abdou Alboul-Aziz a expliqué que
pour renouveler son permis l’usager paye 7000 FCFA de Taxe fiscale et 12
000FCFA de frais d’édition. Celui qui a perdu son permis aura à ajouter à la
somme précitée 5000FCFA. Pour le nouveau dossier l’usager paye 5000FCFA de
frais de dépôts, puis un autre 5000FCFA par catégorie ensuite le frais de
prestation de service et de l’édition. Pour le détenteur de l’attestation
provisoire il aura seulement à payer 12 000 FCFA de frais d’édition. Le
certificat médical est aussi nécessaire car il détermine l’aptitude du client.
Il a précisé qu’avec cette nouvelle réforme l’usager de Niamey peut avoir son
permis dans les 48 heures après le dépôt de son dossier et 10 jours au maximum
pour ceux de l’intérieur du pays.
Le Secrétaire Général du Ministère des Transports, M. Zakaouanou Attaoulahi a
estimé quant lui, qu’avec l’uniformité de signature, la création de base de
données et un détecteur de faux permis qui sera mis à disposition de la police,
la population aura un permis sécurisé et «
nous mettons fin au récurrent problème d’imprimé ».
Plusieurs questions ont été posées par les journalistes dont celle relative aux raisons qui ont poussé la HALCIA à s’intéresser à cette question de permis de conduire. A ce sujet, le directeur de la Législation, M. Adam Zakari a déclaré qu’il est normal que cette institution, de par sa mission, s’approche du Ministère des Transports pour vérifier si les allégations des citoyens sont fondées ou pas. Pour ce qui du danger de la non implication des usagers dans le processus de la réforme, M. Adam Zakari a dit que l’administration peu impliquée les usagers là où la Constitution lui impose cela tout comme elle est souveraine au cas où la loi ne lui impose pas cela pour ensuite informer la population.
D’ailleurs, le renouvellement du permis est une occasion qui permet de vérifier si l’usager est toujours adapté à continuer à conduire étant entendu qu’au cours du temps, il peut devenir inapte. Mieux, le renouvellement se fait en fonction de la catégorie. Les permis sont renouvelables entre la période de 2 à 10 ans. Notons par ailleurs, que le titulaire du permis de conduire toutes catégories confondues dispose d’un délai de 12 mois à compter du lundi 22/07/2019 pour passer au biométrique sous peine de sanction. Les dispositions sont prises pour que les usagers puissent renouveler leurs permis à travers le Centre National de Traitement et de l’Edition du permis de conduire biométrique de Niamey ou les directions régionales des transports.
