En application de l’article 73 de la Constitution, le Premier Ministre a reçu du Président de la République, une délégation de pouvoirs pour la présidence d’un Conseil des Ministres.
C’est ainsi que Son Excellence, Monsieur OUHOUMOUDOU MAHAMADOU, Premier Ministre, Chef du Gouvernement a présidé ce jour, lundi 1er novembre 2021, un Conseil des Ministres.
I. AU TITRE DU MINISTERE DES FINANCES
Le Conseil des Ministres a adopté les projets de textes ci-après :
1.1 Projet de décret fixant la tutelle, l’organisation, le contrôle et les modalités de fonctionnement des établissements publics.
Le présent projet de décret détermine la tutelle, l’organisation, le contrôle et les modalités de fonctionnement des établissements publics.
Il prévoit une double tutelle à savoir la tutelle financière exercée par le Ministre chargé des finances et la tutelle technique exercée par le Ministre chargé du secteur concerné.
Il détermine également les organes de gestion, le mode de fonctionnement ainsi que les modalités de contrôle de performance des établissements publics.
1.2. Projet de décret portant règles de création, de tutelle et de contrôle des Entreprises Publiques.
Le présent projet de décret a pour objet d’encadrer la création, la gestion, la tutelle, le contrôle de performance ainsi que les inspections et audits des sociétés d’Etat, des sociétés à capital public et des sociétés d’économie mixte, sous réserve des dispositions de l’Acte Uniforme révisé sur le droit des sociétés commerciales et du Groupement d’Intérêt Economique de l’OHADA.
1.3 Projet de décret précisant les dispositions spécifiques aux établissements publics à caractère Industriel et Commercial (EPIC).
Le présent projet de décret édicte des dispositions spécifiques applicables aux établissements publics à caractère Industriel et Commercial.
Il précise le mode de gestion, les ressources, les règles comptables et les modalités d’affectation des bénéfices, le cas échéant, desdits établissements.
II. AU TITRE DU MINISTERE DE L’HYDRAULIQUE ET DE L’ASSAINISSEMENT.
Le Conseil des Ministres a adopté le projet de décret déterminant le mécanisme de financement des aménagements, installations, ouvrages, travaux et activités d’assainissement.
