Les députés réunis en séance plénière, ce jeudi 31 octobre 2019, ont entériné les modifications apportées au code de procédure pénale du Niger.
Il ressort du rapport de la commission des affaires générales et institutionnelles (CAGI que la loi de juin 2018 a fixé l’organisation et la compétence des juridictions au Niger et a institué des chambres criminelles au sein des tribunaux de grande instance pour juger les infractions qualifiées de crimes en remplacement des cours d’assises et créé les chambres criminelles au sein des cours d’appel compétentes pour connaitre en appel des décisions rendues en matière criminelle.
Cette réforme du code pénal en République du Niger a pour objet d’accélérer le traitement des affaires criminelles aux fins de désengorger les prisons.
Elle permet également de déterminer l’organisation et la procédure à suivre devant les chambres criminelles des tribunaux de grande instance des décisions rendues par celles-ci et de pourvoi en cassation.
Au terme du processus de vote, le Ministre de la justice Marou Amadou a tenu à remercier les députés pour ce vote massif.
‘’Vous venez de doter la justice nigérienne d’un instrument juridique qui fera date dans l’histoire. Elle porte essentiellement trois ambitions dont un procès criminel moins lourd, moins coûteux et moins lent’’ , a déclaré le Ministre Marou Amadou avant d’ajouter que ‘’cette loi rendra dès sa promulgation notre justice criminelle permanente, empreinte donc d’accessibilité, de célérité et d’efficacité en même temps qu’elle assure un renforcement des droits des accusés comme des parties civiles tout en garantissant le droit d’appel pour un second réexamen des affaires criminelles’’.
Rappelons que le code de procédure pénale en vigueur au Niger date de 1961.
