Chaibou Moussa d’expliquer qu’à travers cette enquête diligentée par ledit commissariat, ’’ il est ressorti à travers leur procès-verbal en date du 26 octobre 2022,qu’à la suite des évènements des individus se sont rendus sur le site et ont incendié des boutiques et hangars servant d’habitation, et qu’ils ont posé ces actes dans le seul but de créer des fausses preuves pour accabler les Forces de Défense et de Sécurité (FDS) pour créditer leur thèse de massacres qui auraient été effectués par les FDS’’.
D’après les dispositions de l’article 378 du code pénal, ‘’le fait d’incendier des lieux servant d’habitation est un crime qui est assorti de la peine de 10 à 20 ans d’emprisonnement ‘’, a-t-il annoncé.
D’après le procureur, il s’agit des faits criminels et que c’est des faits qui selon les dispositions de l’article 72 du code de procédure pénal nécessite obligatoirement l’ouverture d’une enquête judiciaire devant un juge d’instruction.
‘’C’est la raison pour laquelle nous avons demandé au tribunal de tenir compte du fait que ces faits nouveaux changent complètement la donne et bouleversent la procédure, et nous avons démontré au tribunal qu’il y’a une indivisibilité entre les faits nouveaux qui ont été révélés et les faits qui font l’objet de poursuite en cours devant le tribunal’’, a fait savoir le procureur Chaibou Moussa qui ajoute également que ‘’C’est la raison pour laquelle nous avons démontré au tribunal qui ne pouvait plus continuer à chercher à juger cette affaire puisse qu’elle prenne des dimensions purement et simplement criminelles et le tribunal à fait droit à notre requête’’.
Pour rappel, les évènements dits de Tamou intervenus le 24 octobre 2022, ont occasionné la mort de 11 personnes et fait 23 blessés.
