Les travaux de la première session pour l’année 2021 de la chambre criminelle du Tribunal de grande instance (TGI) de Tahoua ont débuté ce jeudi 1er avril 2021. Durant les dix prochains jours, les juges auront à examiner 20 dossiers impliquant 26 accusés. Ces dossiers concernent, entre autres, les crimes de sang dont 11 cas de coups mortels avec armes, un assassinat et un infanticide ; les crimes contre les biens : 4 cas de vols ou tentative de vols qualifiés ; les crimes contre les mœurs : 3 cas de viol ou tentative de viol dont un cas de viol sur mineure de moins de 13 ans.
Dans son réquisitoire d’ouverture de ces assises, le procureur de la République près ce tribunal, M. Hama Illiassou a d’abord tenu à préciser qu’il ne s’agit pas seulement de la première session, mais il s’agit aussi de la toute première session de la Chambre criminelle étant donné qu’elle n’a jamais siégé depuis sa création.
Le procureur de la République s’est ensuite félicité de la création des chambres criminelles beaucoup de dossiers seront jugés et nous n’entendrons plus cette phrase des détenus : « j’ai duré longtemps en prison sans jugement ».
Il a enfin appelé tous les acteurs, notamment les magistrats, les jurés et les défenseurs commis d’office à jouer pleinement leur rôle pour la réussite de cette session.
Pour sa part, le président du Tribunal de grande instance (TGI) de Tahoua, M. Soumana Ousseini, il a expliqué les raisons de l’institution d’une chambre criminelle, notamment le fait que les cours d’assises n’arrivent plus à juger les dossiers criminels dans des délais raisonnables.
L’ancienne loi qui donnait cette prérogative aux seules cours d’assises se trouve alors dépassée, a-t-il poursuivi, soulignant que deux assises annuelles étaient prévues alors que les contentieux sont de plus en plus importants, entrainant un entassement des dossiers, alors que l’organisation des assises était devenue très difficile ces dernières années avec les moyens financiers que ça implique.
En faisant cette réforme, le Ministère de la Justice voulait surtout rapprocher la justice des justiciables. Il est à noter que la Chambre criminelle, est composée des magistrats du TGI et des jurés. Elle a plénitude de juridiction en 1er ressort et ses décisions sont susceptibles d’appel et d’opposition.
