Après le vote de la Loi N°2019 – 33 du 03 juillet 2019 portant répression de la cybercriminalité au Niger, les parlementaires sont appelés à examiner et adopter ce mardi 19 Mars 2020 le projet de loi N°2019 – 33 portant « interception des communications émises par voie électronique au Niger ». Cette loi est très mal perçue au sein de l’opinion. Son caractère illégal et son anti-constitutionnalité ne cessent de susciter le débat. Elle est considérée par les fronts de l’opposition politique comme « un grave danger pour les libertés collectives et individuelles ».
C’est à travers un communiqué de presse que l’opposition nigérienne a fustigé le projet d’adoption de cette loi qu’elle considère comme une violation flagrante des dispositions de l’article 29 de la constitution de la constitution qui dispose « le secret de la correspondance et des communications est inviolable, il ne peut y être dérogé que dans les conditions et formes définies par la loi, sous peine de sanction »
Pour l’opposition politique, cette loi est une façon pour le gouvernement à 6 mois des élections générales de légaliser ses intentions d’embastiller et réduire au silence toute voix discordante, en prenant comme exemple, l’emprisonnement sur des bases fallacieuses, des responsables du principal parti adversaire comme ça s’est produit en 2016. « Avec cette loi les nigériens n’auront ni vie privée, ni vie professionnelle, elle est en désaccord avec la démocratie et tous les traités et conventions internationaux auxquels le Niger est partie » rapporte le communiqué.
Pour Ibrahima Yacouba, leader de l’opposition, « ce projet est une forfaiture du gouvernement qui porte atteinte gravement au secret des communications privées des citoyens nigériens. Si cette loi est votée, il n’y a plus aucune protection ni aucun secret aux communications émises par les citoyens. Tous les articles de cette loi révèlent la volonté obsessionnelle de ne laisser aucun espace de vie privée ou de libertés aux citoyens nigériens », déplore-t-il.
Le Président du Mouvement patriotique nigérien (MPN) dénonce donc ce qu’il considère ni plus ni moins comme des relents dictatoriaux : « il s’agit, pour ceux qui pourraient encore en douter, des instruments d’un régime autoritaire assumé qui ne peut concevoir que d’autres voix ou opinions puissent s’exprimer dans ce pays. Ce n’est pas un recul pour notre démocratie. C’est plus grave que cela. Ce sont les derniers espaces démocratiques qui sont pris d’assaut par un régime qui n’a plus de considération, même pour les droits et libertés constitutionnels », fustige-t-il tout en appelant à résister « au confinement de la démocratie ».
Elh Idi, acteur de la société civile, considère cette cette loi quant à lui, comme « l’arme d’assaut du régime contre les libertés fondamentales, elle se caractérise par des infractions – bateaux telles que données de nature à troubler l’ordre public sans que vous puissiez préciser les éléments constitutifs de ce trouble à l’ordre public ». Ce dernier met en garde les députés sur l’adoption de la loi et rappelle à ces derniers qu’ils feront face à l’histoire à quelques mois des élections générales dans le pays.
