S’exprimant avant le vote au Parlement vendredi d’une loi sur les interceptions de communications téléphoniques, le ministre de la Justice Marou Amadou a laissé entendre que l’opposition était déjà écoutée. Polémique.
« Vous craignez d’être écoutés. Vous l’étiez depuis, et vous l’êtes encore.
C’est maintenant que ça va être organisé », a lancé le ministre de la Justice devant l’Assemblée nationale. Il répondait à l’opposition qui accuse le gouvernement de vouloir surveiller les Nigériens, sous le prétexte de la lutte antiterrorisme.
Mes propos ont été « sortis de leur contexte », se défend le ministre Marou Amadou. « Je dis que les écoutes sont consubstantielles à tout royaume ou État organisé. Avant les télécommunications, les gens étaient écoutés derrière leurs maisons et on rendait compte au prince. » Avec cette loi, la situation sera plus conforme ajoute le ministre, puisqu’il y aura désormais une instance de contrôle.
Un aveu inacceptable, s’insurge le spécialiste en droit constitutionnel, Aba Assan Boubakar. « Le plus choquant, c’est que le ministre de la Justice passe aux aveux, disant que de tout temps les gens ont été écoutés, sans l’intervention de la loi, ce qui est totalement illégal. L’article 29 nous dit que c’est passible de sanctions. Et donc quelque part, c’est une pratique illégale qui est en train d’être légalisée », constate-t-il.
Si nous sommes un état de droit, nous devons faire respecter les libertés fondamentales, ajoute-t-il, estimant qu’une plainte pourrait être déposée.
