La Cour de Justice de la Communauté Économique des États de l’Afrique de l’Ouest (CEDEAO) a annoncé le 14 mars 2025, dans une ordonnance rendue publique, la radiation de plusieurs affaires impliquant le Burkina Faso, le Mali et le Niger. Cette décision fait suite au retrait officiel de ces trois pays de l’organisation sous-régionale.
Dans l’ordonnance n° ECW/CCJ/ORD/02/25, signée par le président de la Cour, Ricardo Cláudio Monteiro Gonçalves, il est précisé que la Cour n’est désormais plus compétente pour juger des affaires concernant ces États. Cette mesure entraîne donc la suppression de 33 affaires judiciaires du rôle de la Cour.
Le Burkina Faso voit ainsi cinq affaires être annulées, parmi lesquelles celles impliquant des figures comme M. Stellio Capo Chichi, alias Kemi Seba, contre l’État burkinabé, ou encore Traoré Frédéric.
Le Mali, quant à lui, enregistre la suppression de 16 affaires, incluant notamment des litiges impliquant Kassoum Keïta, l’organisation Reporters sans Frontières (RSF) ou encore des plaintes collectives regroupant plusieurs dizaines de requérants.
Le Niger est également concerné par cette décision, avec 12 affaires retirées, dont celles opposant Hama Amadou, Mahamane Tar Choukou et M. Idrissa Djibo à l’État nigérien.
La radiation de ces affaires souligne l’impact direct du retrait du Burkina Faso, du Mali et du Niger de la CEDEAO sur le cadre judiciaire communautaire. Désormais, les citoyens et organisations de ces pays ne pourront plus porter plainte devant la Cour de Justice de la CEDEAO, réduisant ainsi leurs options en matière de recours juridique au niveau régional.
Alors que la CEDEAO poursuit ses activités avec les autres États membres, le départ de ces trois pays continue d’avoir des répercussions sur plusieurs plans, notamment en matière de justice et de protection des droits des citoyens.
